AN ACT

To amend chapter 266, RSMo, by adding thereto one new section relating to genetically enhanced seed, with an effective date.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 266, RSMo, is amended by adding thereto one new section, to be known as section 266.142, to read as follows:

266.142. 1. As used in this section the following terms shall mean:

(1) "Agreement", a seed purchase and planting agreement between a producer and a seed dealer or company which sells genetically enhanced seed (GES) agricultural planting seed;

(2) "Genetically enhanced seed" or "(GES)", genetically modified or enhanced seed used in production of principal agricultural crops: soybeans, cotton, wheat, rice, and other principal grain and oilseed crops. GES does not include vegetable or fruit crops;

(3) "Seed dealer", a person or company which sells or resells seed for principal agricultural crops;

(4) "Producer", a farmer or other producer of grain, rice, and oilseed crops.

2. Agreements signed by farmers and other individuals with seed dealers at the time of purchase of genetically enhanced or modified seed shall have a provision that allows the farmer or individual to plant seed derived from the originally purchased seed on his or her own land or on land rented by the original purchaser of the (GES). This provision shall be consistent with federal law.

3. Seed dealers or companies that sell seed may still require in the seed purchasing agreement that seed derived by planting GES may not be sold, given away, or otherwise distributed to any other person, group, entity, or company.

4. The provisions of this section shall not apply to producers who by contract with a seed producing company, have a specific contract to grow GES that will be sold by that seed producing company.

5. The provisions of this section shall become effective January 1, 2005.
