AN ACT

To amend chapter 416, RSMo, by adding thereto one new section relating to state court jurisdiction over price discrimination cases.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 416, RSMo, is amended by adding thereto one new section, to be known as section 416.171, to read as follows:

416.171. 1. The Robinson-Patman Price Discrimination Act, 15 U.S.C. 13, et seq., is enforceable in all state courts of Missouri.

2. The provisions of the Robinson-Patman Price Discrimination Act shall be applicable to sales and transactions occurring at least in part within the state and shall be enforceable in all state courts of Missouri including injunctive relief provisions.

3. Notwithstanding any provision of law to the contrary, any individual, corporation, firm, partnership, incorporated or unincorporated association, municipalities or other government agencies, or any other legal or commercial entity may bring suit in state court pursuant to the provisions of the Robinson-Patman Price Discrimination Act.

4. The attorney general shall have the power to intervene in any suit brought pursuant to the provisions of the Robinson-Patman Price Discrimination Act in the same manner as any other suit.

5. State courts may use any federal court interpretation of the Robinson-Patman Price Discrimination Act as a basis for adjudication of any suit brought pursuant to this section.
