AN ACT

To amend chapter 196, RSMo, by adding thereto one new section relating to the establishment of the Missouri healthy families trust fund.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 196, RSMo, is amended by adding thereto one new section, to be known as section 196.1014, to read as follows:

196.1014.  1.  The state treasurer shall deposit in the Missouri healthy families trust fund all moneys received by the state of Missouri which are the proceeds of any award or settlement resulting from any dispute between the state and any company which manufactures, sells or promotes tobacco or tobacco products.

2.  Notwithstanding the provisions of section 33.080, RSMo, to the contrary, moneys deposited in the Missouri healthy families trust fund, including any interest thereon, shall not revert to the credit of the general revenue fund at the end of the biennium.

3.  After July 1, 2003, the moneys deposited in the Missouri healthy families trust fund, including any interest thereon, shall be appropriated by the general assembly for the following purposes only:

(1)  Twenty-five percent of the moneys shall be used for health care of senior citizens, including but not limited to prescription drugs and oral care which may result from tobacco use;

(2)  Twenty-five percent of the moneys shall be used for health care of citizens for tobacco-related diseases, ten percent of which for the first five years shall be used for tobacco-related prevention and cessation programs;

(3)  Twenty-five percent of the moneys shall be used for children of the state, at least fifteen percent of which shall be used to promote the healthy development of children and youth including but not limited to parents as teachers, after school programs and children's oral health, and at least ten percent of which for the first five years shall be used for capital improvement of schools; and

(4)  Twenty-five percent of the moneys shall be used for health research and development regarding tobacco-related diseases and their prevention, including but not limited to cardiovascular diseases and cancer of the lungs, mouth and esophagus.

4.  The commissioner of administration shall maintain data in an electronic format on receipts to and expenditures from the Missouri tobacco settlement trust fund.  Such data shall be updated at least quarterly, shall indicate expenditures by object type and class, and shall be available to the public on the Internet.
