AN ACT

To amend chapter 130, RSMo, by adding thereto one new section relating to the disclosure of the identity of political phone callers, with penalty provisions.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 130, RSMo, is amended by adding thereto one new section, to be known as section 130.170, to read as follows:

130.170.  1.  If any person or any device makes a telephone call to a telephone line in this state supporting, opposing or providing information about any candidate or ballot measure, such person or device shall, prior to the termination of such telephone call, identify in a clear and conspicuous manner the:

(1)  Entity making the telephone call;

(2)  Entity that is paying for the making of the telephone call; and

(3)  Person or ballot measure, if any, on behalf of which the call is being made.

2.  Any person or entity making or paying for a call described in subsection 1 of this section shall file its name, address and telephone number with the ethics commission.

3.  Any person who violates the provisions of this section shall be subject to the penalty provisions in section 130.081.
