AN ACT
To amend chapter 208, RSMo, by adding thereto one new section relating to a pharmaceutical assistance program, with penalty provisions and a contingent termination date.
Section A. Chapter 208, RSMo, is amended by adding thereto one new section, to be known as section 208.800, to read as follows:
208.800. 1. There is hereby created a "Senior Citizen's Pharmaceutical Assistance Program" within the division of aging. The program shall assist qualified senior citizens in paying the cost of prescription drugs, medical supplies, and medical assistive technology devices. Qualified senior citizens shall be sixty-five years of age or older and shall have an annual household income of fifty thousand dollars or less. For purposes of this section, "household income" shall mean the adjusted gross income, as defined in section 62 of the United States Internal Revenue Code, of all members of a household.
2. Any qualified senior citizen may apply to the division for reimbursement of actual expenditures made for prescription drugs, medical supplies, and medical assistive technology devices after such expenditures exceed five hundred dollars for the year. The division shall reimburse qualified senior citizens for seventy-five percent of the expenditures made for prescription drugs, medical supplies, and medical assistive technology devices, up to a total of one thousand dollars in annual reimbursements, within the limits of the appropriation therefor, upon the submission of appropriate documentation, as determined by the division, supporting the qualifications and expenditures of the senior citizen. The division shall prepare and distribute forms for that purpose.
3. Any pharmacy, as defined in section 338.210, RSMo, may submit claims to the division on behalf of senior citizens. Such pharmacy may add two percent to the total amount charged to pay for administrative costs. The division shall prepare forms for use by pharmacies and may promulgate rules pursuant to chapter 536, RSMo, for the development of supporting documentation.
4. Any person who knowingly violates the provisions of this section, or who permits or encourages the violation of the provisions of this section shall be guilty of a class C felony if the amount involved is seven hundred and fifty dollars or more or a class D felony if the amount involved is between five hundred and one dollars and seven hundred fifty dollars.
Section B. The provisions of section 208.800 shall terminate upon passage of similar federal legislation or regulation.
