SB 940 - This act allows distributors and wholesalers of non-alcoholic beer and intoxicating liquor with an alcohol content of less than five percent by weight to withdraw or replace damaged stock and compensate the retailer for any loss.

A retailer is prohibited from selling non-alcoholic beer or intoxicating liquor with an alcohol content of less than five percent in a package which is in any way torn or mutilated.

The wholesaler or distributor may, within 72 hours, take back any intoxicating liquor with an alcohol content of less than five percent by weight or non-alcoholic beer sold to a caterer and credit such caterer for the returned product.

The Supervisor of Liquor Control is not required to test product samples to determine alcohol content if the product has a certificate issued by the Federal Bureau of Alcohol, Tobacco and Firearms verifying the alcohol content of the product.
