SB 813 - This act changes some of the procedures for the discipline of law enforcement officers. It distinguishes between simple punitive actions for which an officer may request a hearing before a designated individual or board, and punitive actions resulting from an investigation or interrogation, in which case it creates a right to a hearing before a grievance committee.

The act institutes new requirements of written notice to officers of the reason for discipline, together with explanatory citation to the law enforcement entity's written policies. The act clarifies rights and responsibilities of officers subject to discipline and the entity disciplining the officers, including a procedural timetable and due process guidelines, a right to notice of an ongoing investigation, and the right to counsel. The act broadens coverage of the disciplinary procedure to include officers employed by the state. The act utilizes existing written procedures guidelines of law enforcement entities, and calls for the creation of such where not already in place.
