AN ACT

To amend chapter 331, RSMo, relating to chiropractors by adding thereto one new section relating to spinal manipulation, with penalty provisions.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 331, RSMo, is amended by adding thereto one new section, to be known as section 331.034, to read as follows:

331.034.  1.  No person shall perform a manipulation or adjustment of the vertebral column, joints or adjacent structures unless such person:

(1)  Has the legal authority to differentially diagnose; and

(2)  Has received a minimum of four hundred hours of classroom instruction in spinal manipulation or spinal adjustment; and

(3)  Has received a minimum of eight hundred hours of supervised clinical training at a facility where spinal manipulation or spinal adjustment is a primary method of treatment.

For purposes of this section, the terms "manipulation" and "adjustment" shall mean a method of skillful and beneficial treatment using direct thrust or leverage to move a joint beyond the normal range of motion but without exceeding the limits of anatomical integrity.

2.  Any person who violates this section shall be guilty of the unlawful practice of chiropractic and shall be subject to penalties pursuant to section 331.080, or disciplinary action as provided by law.

3.  The provisions of this section shall not apply to osteopathic or medical physicians licensed pursuant to chapter 334, RSMo.
