AN ACT

To amend chapter 33, RSMo, by adding thereto two new sections relating to minority business contracts.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 33, RSMo, is amended by adding thereto two new sections, to be known as sections 33.757 and 33.763, to read as follows:

33.757.  In any contract where there is a minority business participation goal, no subcontract shall be awarded to a minority business unless the contracts are awarded by closed bid and the general contractor identifies how much less his or her bid submitted to the state agency would cost if the subcontract would have been awarded to the lowest and best bidder.  The general contractor shall provide documentation of the differences in the subcontract bid costs to the agency requesting the bid.  Each agency shall annually give an account of any reported differences described in this section to the office of administration.

33.763.  1.  Beginning in the year 2001 and annually thereafter, the office of administration shall collect, correlate and maintain for all state construction, renovation, repair or maintenance contracts the total cost of contracts awarded to minority businesses where the minority business was not the low bidder.

2.  For purposes of this section, the terms "minority business" and "contract" shall have the same definitions as provided in section 33.750.
