AN ACT

To repeal sections 130.072 and 130.081, RSMo 1994, relating to campaign finance disclosure, and to enact in lieu thereof two new sections relating to the same subject.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Sections 130.072 and 130.081, RSMo 1994, are repealed and two new sections enacted in lieu thereof, to be known as sections 130.072 and 130.081, to read as follows:

130.072.  Any person who knowingly or with gross negligence accepts or makes a contribution or makes an expenditure in violation of any provision of this chapter or who knowingly or with gross negligence conceals a contribution or expenditure by filing a false or incomplete report or by not filing a required report, in addition to or in the alternative to any other penalty imposed by this chapter, may be held liable to the state in civil penalties in twice the amount of any such contribution or expenditure, not to exceed a total amount of five thousand dollars.

130.081.  1.  Any person who [purposely] knowingly or with gross negligence violates the provisions of this chapter is guilty of a class A misdemeanor.

2.  Any person who fails to file any report or statement required by this chapter within the time periods specified in sections 130.011 to 130.051 is guilty of an infraction.

3.  Notwithstanding any other provision of law which bars prosecutions for any offenses other than a felony unless commenced within one year after the commission of the offense, any offense under the provisions of this chapter may be prosecuted if the indictment be found or prosecution be instituted within three years after the commission of the alleged offense.

4.  Any prohibition to the contrary notwithstanding, no person shall be deprived of the rights, guarantees, protections or privileges accorded by sections 130.011 to 130.026, 130.031 to 130.068, 130.072, and 130.081 by any person, corporation, entity or political subdivision.
