AN ACT

To amend chapter 8, RSMo, by adding thereto five new sections relating to state buildings and lands.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 8, RSMo, is amended by adding thereto five new sections, to be known as sections 8.950, 8.953, 8.956, 8.959 and 8.962, to read as follows:

8.950.  Sections 8.950 to 8.962 shall be referred to as the "Freedom of Public Access" Act.

8.953.  As used in sections 8.950 to 8.962, the following terms shall mean:

(1)  "Public office space", all facilities owned, occupied or controlled by the state of Missouri pursuant to this chapter;

(2)  "Public parking areas", any area owned or controlled by the state of Missouri subject to this chapter and used to park motor vehicles of any kind except as herein provided;

(3)  "Successful bidder", the highest and best bidder for each parking area or office space as determined by the office of administration.

8.956.  1.  All public office space not occupied or used by officials or employees of the state of Missouri, and not open to the constant use of the general public, shall be offered at public bid on an annual basis.  Successful bidders shall be entitled to the exclusive use of the public office space successfully bid upon for the annual period of the bid.  The office shall be clearly marked with a sign designating the identity of the successful bidder for the duration of the annual bid.  This section shall not be construed to require any public office space not currently occupied and used by public employees to be made available for public bid.

2.  Only vehicles authorized by the successful bidder shall be given access to the parking area that is the subject of the bid and all other vehicles shall be given a citation for the parking violation not to exceed five dollars and towed from the parking area at the owner's expense.

8.959.  Upon appropriation, all revenues produced pursuant to sections 8.950 to 8.962 shall be appropriated and expended in the following order:

(1)  The expenses related to the enforcement of sections 8.950 to 8.962;

(2)  The maintenance or cost associated with the public office space and public parking space; and

(3)  The blind pension fund.

8.962.  Sections 8.950 to 8.962 may be enforced by any taxpayer filing an action in the circuit court of jurisdiction.  Public bids subject to section 8.956 shall be offered and awarded by the office of administration.
