AN ACT

To amend chapter 105, RSMo, by adding thereto one new section relating to the Missouri ethics commission.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 105, RSMo, is amended by adding thereto one new section, to be known as section 105.990, to read as follows:

105.990.  1.  No member of the general assembly, statewide elected official or judge shall directly or indirectly contact the Missouri ethics commission on behalf of any individual with regard to the employment of that individual by the Missouri ethics commission, except as provided by this section.

2.  No applicant for employment by the Missouri ethics commission may designate as a reference with respect to such application any member of the general assembly, statewide elected official or judge, unless such applicant was previously employed by the designated public official.  In such event, the administrative secretary of the commission may personally contact the public official only in order to verify that the applicant was in fact previously employed by the public official, and for no other purpose.  No application for employment supported by a member of the general assembly, statewide elected official or judge shall be given any greater consideration than the application for employment of any other qualified applicant.  Any application for employment submitted in violation of this subsection shall be disregarded and returned to the applicant.

3.  Employment of employees and staff of the Missouri ethics commission by the executive director pursuant to subsection 11 of section 105.955, RSMo, shall be subject to the provisions of chapter 36, RSMo.

4.  Any violation of this section shall be reported by any person to the

Missouri ethics commission, and may also be reported to the standing ethics committee of the house of representatives or the senate, as applicable.  Any person who violates this section shall be subject to appropriate discipline for such violation as is otherwise provided by law.
