AN ACT

To repeal sections 478.117 and 478.570, RSMo 1994, relating to circuit courts, and to enact in lieu thereof three new sections relating to the same subject.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Sections 478.117 and 478.570, RSMo 1994, are repealed and three new sections enacted in lieu thereof, to be known as sections 478.117, 478.187 and 478.570, to read as follows:

478.117.  1.  Until August 28, 2000, circuit number seventeen shall consist of the counties of Cass and Johnson.

2.  Beginning August 28, 2000, circuit number seventeen shall consist of the county of Cass.

478.187.  1.  Beginning August 28, 2000, circuit number forty-six shall consist of the county of Johnson.

2.  There shall be one circuit judge in the forty-sixth judicial circuit.

3.  The circuit court judge who sat in division two of the seventeenth judicial circuit on August 27, 2000, beginning August 28, 2000, shall be the circuit judge of the forty-sixth judicial circuit and shall hold office for the remainder of the term to which he was elected or appointed, and until his successor is elected and qualified.

478.570.  1.  There shall be two circuit judges in the seventeenth judicial circuit consisting of the [counties] county of Cass [and Johnson].  These judges shall sit in divisions numbered one and two.

2.  The circuit judge in division two shall be elected in [1980] 2002.  The circuit judge in division one [shall be elected in 1982] of the seventeenth judicial circuit on August 27, 2000, shall remain the circuit judge of the seventeenth judicial circuit in division one on and after August 28, 2000, and shall hold office for the remainder of the term to which he was elected or appointed, and until his successor is elected and qualified.

3.  Notwithstanding the provisions of section 478.320, there shall be one additional associate circuit judge than the number determined pursuant to section 478.320, to be elected in Cass county in 2002.
