Current Bill Summary

SCS/SB 274 - This substitute creates the crime of infanticide for certain partial birth abortion procedures. The act contains definitions of "born", "partially born" and "serious physical injury"; prohibits partial birth abortions as infanticide, unless necessary to preserve the life of or prevent serious physical injury to the mother; prohibits prosecution of the mother; and provides that infanticide is a Class A felony. The phrase "irrespective of the duration of pregnancy" is deleted from the act and replaced with a "post-viability" limitation. "Post-viability" is also added to section 565.300.

This substitute is substantially similar to SB 345 and SCS/HB 427.
