SCS HB 1145 -- PUBLICATION OF LEGAL NOTICES

This bill authorizes the publication of legal notices in a
newspaper of general circulation that has interrupted
publication for up to 30 consecutive days when the newspaper is
the successor to a defunct newspaper.  Current law requires the
newspaper to have published regularly and consecutively for 3
years unless the publication is suspended due to the owner's
induction into the armed forces during a time of war.

The bill also clarifies that any qualified newspaper publishing
laws, proclamations, nominations to office, public referendums,
or legal notices must charge the regular local classified
advertisement rate.  The rates for the publication of public
notices and advertisements in newspapers located in first class
counties or the City of St. Louis may be reviewed and approved
by a majority of the judges of the local circuit court.

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee
on Civil and Administrative Law by a vote of 13 to 0.

This bill authorizes the publication of legal notices in a
newspaper of general circulation that has interrupted
publication for up to 30 consecutive days when the newspaper is
the successor to a defunct newspaper.  Current law requires the
newspaper to have published regularly and consecutively for 3
years unless the publication is suspended due to the owner's
induction into the armed forces during a time of war.

FISCAL NOTE:  No impact on state funds.

PROPONENTS:  Supporters say that the legislation updates the
term second class mail to periodicals pursuant to the
nomenclature of the U. S. Postal Service.  The legislation also
allows a successor in ownership of a newspaper to continue to
publish legal notices for a 30 day period upon acquisition of a
defunct newspaper.

Testifying for the bill were Representative Lakin; and Missouri
Press Association.

OPPONENTS:  There was no opposition voiced to the committee.
