HB 1037 -- EQUIPMENT DEALERS AND MANUFACTURERS (Leake)

This bill gives a manufacturer, wholesaler or distributor of
farm implements, industrial maintenance and construction power
equipment, or outdoor power equipment 90 days to make a
determination on a request by a farm implement dealership,
industrial maintenance and construction power equipment
dealership, or outdoor power equipment dealership to sell or
transfer any portion of business ownership to another party or
to enter into an agreement to operate the dealership with
another party.  The dealership is to provide the manufacturer
with reasonable financial information, personal background,
character references, and work histories as may be required by
the manufacturer to make such determination.  If the request is
not acceptable, the manufacturer or distributor is to provide a
written notice of the determination with the reasons for
nonacceptance.

FISCAL NOTE:  No impact on state funds.

OPPONENTS:  There was no opposition voiced to the committee.
