HCS/SB 908 - This act defines procedures by which an adversely affected person or entity may prove to an agency that it has detrimentally relied upon an agency interpretation of law.
The process would allow the person or entity so affected to obtain proceedings before the agency to prove the nature and extent of the reliance, and force the agency to enter findings and conclusions on the matter. If the agency determines that detrimental reliance has occurred, the agency would only be allowed to enforce the interpretation prospectively.
The effective date of the act would be January 1, 1999.
