SB 742 - This act regulates telephone solicitations and change of telephone service.

TELEPHONE SOLICITATIONS - The act prohibits telephone solicitations before 8 a.m., between 5 p.m. and 6 p.m. or after 10 p.m. Solicitors must also establish a "do-not-call" list. Solicitors must keep record of subscriber's request to be put on the do-not-call list.

The Public Service Commission shall seek orders enjoining suspected violators of the solicitation hours or do-not-call requirements. Violation of those provisions is an infraction.

CHANGE OR TELECOMMUNICATIONS SERVICE - Changes of telecommunications company shall be verified according to this section.

If the company initiates the call, the change shall be verified by one of three means: 1) independent, third-party verification of the customer's oral agreement to the change, 2) electronic authorization from the customer's home phone or 3) written letter of agency from the customer. If a change is made by oral agreement or electronic authorization, the company shall send a verification package to the customer within three business days.

If a customer denies that a change was authorized, the burden of proof shall be on the company making the change. If a company makes an unlawful change, the company shall be liable to the previous company for any charges incurred after the change and the customer shall not be liable for such charges. If a company is a habitual violator, the Public Service Commission may require all changes to that company to be verified by signed letter of agency for a period of up to two years. If a company falsifies a signature to authorize a change, the Public Service Commission may revoke the company's certification to provide telephone service.
