CCS/HCS/SB 739 - This act pertains to the regulation of subdivisions. Current law exempts parcels of ten acres or larger from county planning and zoning in first-class, non-charter counties. Similar provisions are truly agreed to in HB 1928.

The act reduces the size threshold for this exemption from ten acres to five acres for such counties, except Greene county which will remain at ten acres.

The act provides that the term "subdivision", as used by the Clean Water Commission to regulate wastewater systems under Chapter 644, RSMo, shall not include lots of five acres or larger or land divided into parcels of five acres or larger.

The act also adds a provision that the Clean Water Commission of the State of Missouri may by rule adopt a rebuttable presumption that streams located within one mile upstream of an ascertained "losing stream", may also be determined a "losing stream".
