Current Bill Summary

HS/HCS/SCS/SB 722 - This act restricts the use of domestic violence information and genetic testing information by insurance companies. It also provides for domestic violence victims, life insurance illustrations and cloning research.

GENETIC TESTING - Health insurers shall not use genetic information or tests when establishing eligibility for coverage, premiums or any other underwriting criteria. No genetic test may be required of the insured or any blood relatives, nor may a test refusal be considered. A violation is considered an unfair trade practice. An exception is made for life, disability and long- term care insurance.

Employers may not use genetic information or test results to discriminate against an employee. A violator is subject to a maximum fine of $500 per violation. An exception is made for life, disability and long-term care insurance. Genetic information shall be kept confidential by any person keeping it, with exceptions.

DOMESTIC VIOLENCE - Insurers are prohibited from discriminating against victims of domestic violence when issuing, renewing or canceling a policy. "Domestic violence" includes physical harm and certain sexual injuries. Insurers are also prohibited from restricting coverage, increasing premiums, denying claims or terminating group coverage. Any violation will be considered an unfair trade practice. This provision was also truly agreed to in HB 1918.

CRIME VICTIMS - Crime victim funds may be used for additional services related to domestic violence.

LIFE INSURANCE - Life insurance illustrations shall be identified for the Department of Insurance, shall contain listed information and shall meet numerous other requirements. (Similar to HB 958)

CLONING - The act prohibits the use of state funds in cloning research.
