SB 681 - This act repeals all quotas based on race, sex, color, ethnicity and national origin contained in any laws, executive orders, policies and rules. The act affects only preferential treatment for public employment, education and contracting with the state, any political subdivisions, including public universities, and agents.

Preferential measures are allowed if the state has made a finding, supported by clear and convincing evidence that: (1) specific, pervasive and systematic discrimination has occurred in the past and will continue to occur in the future; (2) the measure is narrowly tailored to further a compelling governmental interest; and (3) the preferential measures will sunset after two years.

The act allows preferences necessary to establish or continue eligibility for federal funds. The act grants standing to sue to enforce this section to affected parties, or any Missouri taxpayer.
