Current Bill Summary

SCS/SB 646, 573, 527, 493, 575, 546, 663 & 904: This act creates the following crimes:

JUMPING FROM COMMERCIAL PASSENGER BOATS: A person jumping or diving from a commercial passenger boat without permission of the boat's operator commits a Class C misdemeanor. A Class C misdemeanor carries a jail term of up to fifteen days. This provision is similar to SB 63 from 1997.

ASSAULT OF OFFICER: Creates the new crime for assault of a law enforcement officer by knowingly attempting to take any deadly weapon, a Class B felony.

ASSAULT OF SPORTS OFFICIAL: A person commits the crime of intimidation of a coach or sports official if he commits any of the following acts against such official and such act is motivated by the victim's status as a coach or sports official: 1) attempting to injure the coach or official; 2) threatening the coach or official; 3) touching the coach or official in an offensive manner; or 4) communicating to the coach or official a threat to commit any felony. Intimidation of a coach or sports official is a Class D felony. This language is similar to Section 574.093, RSMo, which creates the crime of ethnic intimidation in the second degree. A sports official is defined as a referee, umpire or other official who registers with an organized training body or a person who volunteers as an official.

POLICE ANIMALS: This act makes it a Class D felony to assault or kill a police animal while such animal is involved in law enforcement investigation, apprehension, tracking or search, or under the custody of a law enforcement or Department of Corrections officer, municipal police department, fire department or a rescue unit or agency. This provision is similar to SB 235 from 1997.

EVADING AN OFFICER: A person commits the crime of evading a peace officer if he is operating a motor vehicle, is directed by an officer to stop, and takes deliberate action to evade the officer. The offense is either a Class C felony, unless the person was evading a misdemeanor arrest, in which case it is a Class A misdemeanor.

LEAVING SCENE OF A SHOOTING: This act establishes the crime of leaving the scene of a shooting without notifying law enforcement. A person commits this crime if he: 1) discharges a firearm or projectile weapon, as defined in Section 571.010, RSMo; 2) causes injury or death to another; and 3) leaves the place of the shooting without giving identifying information to a police officer. A person may leave the scene of a shooting to obtain medical assistance or contact a police officer so long as he returns to the scene. Conservation agents are authorized to investigate hunting related shootings under this act. Leaving the scene of a shooting is a Class A misdemeanor for a first offense and a Class D felony for a second and subsequent offense. A Class A misdemeanor carries a sentence of up to one year while a Class D felony is punishable by a term not exceeding five years. This provision is identical to the SB 32 from 1996.

BODY PIERCING/TATOOING: This act prohibits the tattooing, branding, or body piercing of minors without the prior written consent of the minor's parent or legal guardian. This act also prohibits the tattooing, branding, or body piercing of persons who are under the influence of intoxicating liquor or a controlled substance. Violators of this act are guilty of a misdemeanor and shall be fined no more than five hundred dollars.

COUNTERFEITING OF MERCHANDISE: This act prohibits counterfeiting of merchandise. A violation is either a Class A misdemeanor, or Class D or C felony, depending on the quantity or retail value of items involved and the number of previous violations.
