HB 1557 Changes Election Dates & Deadlines

SCS/HCS/HBs 1557 & 1489 - This act makes changes to election dates and deadlines, as described below.

1. PRESIDENTIAL NOMINEES. SECTION 115.399. The deadline for certifying the party nominees for U.S. President and Vice President is changed from the 10th Tuesday to the 12th Tuesday before the presidential election, or within 7 working days after the state committee of each established political party chooses its nominees, whichever is later.

2. ELECTION DATES. SECTION 115.123. This is identical to the section in SCS/SBs 652 & 548, as amended on the floor.

The October election dates are removed. As a result, elections would be held on:

February or March, but not both; April; June for school district elections only; August, primary years; August, nonprimary years for school district elections only; and November.

3. ELECTION DEADLINE CHANGES. This act makes changes to various election dates for 10-week ballot certification:

1. Vacancy of sheriff--10th Tuesday, Section 57.080;

2. Utilities, franchises and contracts--10th Tuesday, Section 88.251;

3. Notice to election authorities of the calling of election, Section 115.125;

4. Declaration of candidacy--15th Tuesday through 11th Tuesday, Section 115.127.5;

5. Withdrawal of candidacy--8th or 10th Tuesday, Sections 115.127.6 & 115.359.1;

6. Petitions - Secretary of State's determination of compliance--11th Tuesday, Section 115.333.1;

7. Vacancy - selection by party nominating committee--8th Tuesday, Section 115.373.1;

8. Party emblem submitted to Secretary of State--12th Tuesday, Section 115.385.1;

9. General election candidates, list sent to election authorities by 10th Tuesday, Section 115.401; and

10. Contested election - case concluded by 10th Tuesday, Section 115.535.

11. Filing for new party and independent candidates - 15th Tuesday, Section 115.329.

This act has an emergency clause.
