SCS/HS/HB 839 - This act requires any political subdivision which requires building permits for construction projects to require a transient employer to show proof of having a tax clearance and having filed a financial assurance instrument, before issuing a building permit. The Department of Revenue shall request a temporary restraining order or seek injunctive relief to prohibit further performance of work by a transient employer who does not meet the requirements, but allows the work to be continued by someone else. The provisions of this act do not create a liability or cause of action against a city or county with regard to the issuance of a license.

Any contractor for private or public construction work who engages a subcontractor who is a transient employer, shall require the subcontractor to show proof that the subcontractor has filed a financial assurance instrument and holds a current valid certificate of workers' compensation insurance coverage. No work shall be performed by the subcontractor until proof of compliance is shown. No proof of compliance is required if the subcontractor has previously shown proof of compliance to the state agency or political subdivision for which work is performed. A contractor who is notified by the Director of Revenue or Division of Workers' Compensation that a subcontractor is in violation of the bonding requirements for transient employers shall withhold payment to the subcontractor for satisfaction of the subcontractor's obligations as a transient employer, if directed to do so, and the subcontractor shall be deemed in compliance.

The names of transient employers performing work on construction projects in Missouri shall be published in the Missouri Register.
