AN ACT

To amend chapter 109, RSMo, by adding thereto one new section relating to the creation of the state document preservation fund.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 109, RSMo, is amended by adding thereto one new section, to be known as section 109.005, to read as follows:

109.005. 1. There is hereby established in the state treasury a special fund to be known as the State Document Preservation Fund . The fund shall consist of all moneys received from gifts, bequests, contributions or fees for the specific purpose of preserving legal, historical and genealogical materials and making them available to the public.

2. The state treasurer shall invest moneys in the state document preservation fund in the same manner as surplus state funds are invested pursuant to section 30.260, RSMo. All earnings which result from the investment of moneys in the state document preservation fund shall be credited to the fund.

3. Any unexpended balance in the state document preservation fund at the end of any appropriation period shall not be transferred to the general revenue fund of the state treasury and, accordingly, shall be exempt from the provisions of section 33.080, RSMo, relating to the transfer of funds to the general revenue fund of the state treasury.

4. The general assembly shall appropriate moneys from the fund to the office of the secretary of state to be used exclusively by the archives division to:

(1) Preserve, through any archivally appropriate means, documents of legal, historical and genealogical importance to the state of Missouri; and

(2) Perform all other functions necessary to make these documents available to the public.

5. Once each year, the secretary of state shall report to the general assembly on the expenditure of the moneys appropriated to the archive division for the purpose set out in this section.
