SB 873 - This act codifies recent U.S. Supreme Court language (Adarand v. Pena, 115 S. Ct. 2097 (1995), and Richmond v. Croson, 109 S. Ct. 706 (1989)) in three (3) ways:

1) State-sponsored discrimination is prohibited unless there is clear and convincing evidence that specific, pervasive and systematic discrimination has occurred in the past and will continue to occur in the future;

2) All remedial actions must be narrowly tailored and are automatically limited to a maximum duration of two years; and

3) Voids portions of Executive Order 94-03.
