SB 401 - This act regulates agreements limiting a general contractor's liability, used by a general contractor as a condition of a subcontractor's receiving a contract on a project.
This act makes it clear that any agreement, which is a condition precedent to the letting of a contract, that would indemnify a general contractor for liability arising from the general contractor's own negligence is void and unenforceable.
This limitation shall not apply to insurance contracts or
construction bonds.
