Current Bill Summary

SB 328- This act makes leaving the scene of an accidental shooting a crime. A person is guilty of this crime if he: 1) accidentally or negligently discharges a gun, 2) injures or kills another due to his negligence, and 3) leaves the scene without giving his name and address to a police officer. A person does not violate this law if he leaves to get medical help or notify the police as long as he returns to the scene of the shooting. A person leaving the scene of an accidental shooting is guilty of a Class A misdemeanor or a Class D felony if another person is injured or killed or if he has previously violated this section.
