SB 129 - In any action against a licensed professional for damages or injuries, the plaintiff or the plaintiff's attorney shall file an affidavit with the court stating that, in the opinion of a legally qualified licensed professional, the defendant licensed professional failed to use the care a prudent and careful licensed professional would have used under similar circumstances.

In the event the plaintiff or his/her attorney fails to file the affidavit, the court may, upon motion of any party, dismiss the action against the moving party without prejudice. "Licensed professional" is defined in the act.
