Current Bill Summary

SB 108 - This act would exempt nursing homes operated exclusively for persons with the acquired human immunodeficiency syndrome, AIDS from the Certificate of Need (CON) process. Any exempted facility which houses patients who do not have the acquired human immunodeficiency syndrome, AIDS, will be liable for a fine of $100 per day per resident for each violation.

A certificate of need will not be required for any institution previously owned and operated for, or in behalf of, the City of St. Louis choosing to be licensed as a Residential Care Facility I or II or for facilities with 90 beds or less owned by a not for profit organization controlled directly by a religious organization which had received approval by 8/1/95 and licensed by 7/1/96.

Emergency clause adopted.
