HB 686 -- Child Support

The bill creates 3 new crimes related to diversion of child support funds. The bill:

(1) Makes attorneys who knowingly take or receive child support funds to satisfy a financial obligation of the person entitled to receive the child support money (obligee) guilty of a class D felony. Consent of the obligee is not a defense to this crime;

(2) Makes persons who knowingly cause child support funds to be wrongly transferred to satisfy a financial obligation guilty of a class D felony; and

(3) Makes circuit clerks or deputy clerks who knowingly send a child support payment to an address other than the obligee's home address or an address where the obligee normally receives mail guilty of a class A misdemeanor.
