HB 532 -- Auto Glass Repair

Co-Sponsors: Witt, Rizzo, Montgomery, Thomason

This bill prohibits insurance companies from requiring, threatening, or coercing an insured person to use a particular automobile glass repair shop. The bill also prohibits insurance companies from entering into an agreement with a broker that establishes a price that glass shops must meet as a condition of doing business.

The bill prohibits persons or companies that repair, sell, or replace automobile glass from offering to pay any part of an insurance deductible, paying any person to procure glass shop business, or retaining any fees or percentages of the claim paid by an insurer.

The bill permits insurers to give claimants a list of approved glass repair shops. Claimants are allowed to use a nonlisted shop but may be required to first obtain a maximum of 3 competitive bids.

The bill establishes any violation of prohibited acts as a class B misdemeanor.
