HB 312 -- Abortion

This bill requires a physician performing an abortion or prescribing an abortion pill to explain to the patient the physical and psychological indicators and contra-indicators for abortion relevant to her well-being. The physician must explain the procedure or medication to be used, the expected outcome, the potential complications, the potential side effects, and post-abortion care required. The physician, in forming a professional opinion, must factor in the patient's age, family size, financial concerns, mental health, physical health, and the gestational age of the fetus. The physician performing the abortion or prescribing the abortion pill must be the person consulting with the patient. Such consultation is not required in the event of an emergency, where an immediate abortion is necessary to prevent serious injury or death to the patient.

Any woman suffering physical, emotional or psychological injury that is proximately caused by a physician's failure to fulfill these duties is permitted to recover compensatory damages, all costs and attorneys' fees. Such a suit must be filed within 3 years of the discovery of the causation of the injury.
