HB 220 -- Trade Secrets

This bill is the Missouri Uniform Trade Secrets Act. Any actual or threatened misappropriation of a trade secret may be enjoined by a court. The injunction continues until the trade secret no longer exists, and may be extended for a reasonable length of time to eliminate any commercial advantage that may be derived from the misappropriation. The bill permits monetary damages to be awarded, for actual loss as well as for unjust enrichment. Recovery of punitive damages is allowed in cases where the misappropriation is outrageous.

A court is allowed to preserve a trade secret by closing records and proceedings relating to the trade secret. Discovery in proceedings not involving misappropriation of trade secrets is not to be affected by the bill. Contractual, civil and criminal remedies not based upon misappropriation of trade secrets are not affected by the bill.
