HB 99 -- Medicaid Benefits
Under current law, the Department of Social Services has a right to the entire amount reimbursed by third parties for Medicaid payments. This bill requires the department to pay attorneys' fees incurred in obtaining a third-party recovery. After payment of attorney's fees, the department must pay a proportionate share of the other expenses of the recovery. These payments will be made from the department's share of the amount reimbursed by the third party.
