HB 78 -- Freedom of Expression

The bill grants high school students first amendments rights in their official student publications. News and commentary that is not obscene, defamatory, an invasion of privacy or likely to incite imminent lawless action will not be subject to prior restraint by school board officials and their employees. Journalism advisors will not be subject to discipline for refusing to infringe upon the students' right to freedom of expression. No school district, member of the board of education or employee of the board will be held responsible in any civil or criminal action for any student publication.
