Current Bill Summary

SCS/SB 766 - This act provides that a private school that fails to disclose allegations of sexual misconduct against a former employee when furnishing a job reference for such former employee shall be liable for damages to students who are later found to be victims of sexual misconduct by such person by a court of competent jurisdiction. The private school shall also be liable for damages to the future employer of such person for any legal liability, legal fees, costs, and expenses caused by the private school's failure to disclose allegations of sexual misconduct.

A private school that discloses information as provided in this act shall not be liable for damages incurred by a former employee as a result of such disclosure.
