Current Bill Summary

SB 231 - This act specifies that any new motor vehicle franchise dealer or manufacturer may bring an injunctive action against any manufacturer licensed as a new motor vehicle dealer as provided in the act. Upon prevailing in the action, the petitioning party shall also be entitled to any remedies available under the Motor Vehicle Franchise Practices Act (MVFPA). Any new motor vehicle franchise dealer or manufacturer may also file an action against the Director of the Department of Revenue to compel the Director to comply with the licensure requirements of the MVFPA. Venue for actions against a manufacturer shall be in the circuit court of the county in which the petitioner resides, or in the circuit court of Cole County. Venue for actions filed against the Director shall be in the circuit court of Cole County.
