SS#3/SCS/SB 912 - This act states that in any state fiscal year following a fiscal year where an institution's state operating support increased from the previous fiscal year's state operating support, and such institution's tuition is greater than the average tuition, the percentage change in tuition shall not exceed the percentage change of the consumer price index (CPI) or zero, whichever is greater. In any state fiscal year following a fiscal year where an institution's state operating support did not increase from the previous fiscal year's state operating support, and such institution's tuition is greater than the average tuition, the percentage change in tuition shall not exceed 5% plus the percentage change of the CPI or zero, whichever is greater.

In any state fiscal year following a fiscal year where an institution's state operating support increased from the previous fiscal year's state operating support, and such institution's tuition is less than the average tuition, the dollar increase in tuition shall not exceed the product of zero or the percentage change of the CPI, whichever is greater, times the average tuition. In any state fiscal year following a fiscal year where an institution's state operating support did not increase from the previous fiscal year's state operating support, and such institution's tuition is less than the average tuition, the dollar increase in tuition shall not exceed the product of zero or the percentage change of the CPI plus 10%, whichever is greater, times the average tuition.

In any state fiscal year following a fiscal year where an institution's state operating support increased from the previous fiscal year's state operating support, the percentage change in any fee charged by the institution to students shall not exceed the percentage change of the CPI or zero, whichever is greater. In any state fiscal year following a fiscal year where an institution's state operating support did not increase from the previous fiscal year's state operating support, the percentage change in any fee charged by the institution to students shall not exceed 10% plus the percentage change of the CPI or zero, whichever is greater. The provisions regarding fee caps shall apply to any fee charged to a Missouri resident undergraduate enrolled in twelve credit hours.

The act modifies the definition of "tuition" and adds a definition for "state operating support".

Any institution that exceeds the tuition or fee cap set forth in the act shall remit back to the state, rather than the Coordinating Board for Higher Education, 5% of its current year state operating appropriation.

The provisions of this section of law shall expire on August 28, 2023.
