SCS/SB 853 - Currently, all merchants have the option of providing customers with either a paper or plastic bag for packaging purchased items. Further, political subdivisions are prohibited from imposing any ban, fee, or tax on the use of such bags. This act repeals these provisions.

Under this act, political subdivisions are prohibited from restricting, taxing, prohibiting, or regulating the use of auxiliary containers, as defined in this act, except for containers used on property owned by a county or municipality.

This act is identical to HCS/HB 1396 (2018) and HB 2334 (2018).
