SB 1030 - This act modifies existing law to provide that when any person or entity is liable for the medical expenses of a MO HealthNet participant, payments for medical expenses made by MO HealthNet shall be a debt due to the State and recoverable by the MO HealthNet Division from the liable party. The Division shall have a lien upon any such moneys and the lien shall only attach to compensation for medical expenses related to the participant's underlying claim against the liable or potentially liable third party. Additionally, the State shall have a lien upon any funds owed for medical expenses by any employer that are or might be due under any insurance agreement or self-insurance authority in effect at the time the medical expense or any portion was paid by the Division. The State shall have a right of subrogation to any funds representing medical expenses owed to or received by the employee or any entity acting on his or her behalf.
