Current Bill Summary

SB 556 - This act modifies the definitions for pedestrian and bicycle. This act also modifies requirements for the distance to be maintained when overtaking a bicycle and applies those same provisions to overtaking a pedestrian on or near the roadway. Currently an operator of a motor vehicle is required to leave a safe distance when passing a bicycle, and to maintain clearance until safely past the overtaken bicycle. This act requires that, in addition to the above requirements, an operator of a motor vehicle is required to make a lane change into the next available lane if possible until safely past the overtaken bicycle or pedestrian. Additionally, in no case shall an operator of a motor vehicle leave less than four feet of clearance between the motor vehicle and the bicycle or pedestrian during the passing maneuver. This act also provides that a person who intentionally violates the requirements for maintaining a safe distance when overtaking a bicycle or pedestrian is guilty of a Class C misdemeanor rather than only cases where an accident occurs as in current law.
