SB 31 - Under current law, "controlled substance" is defined as a drug, substance, or immediate precursor listed in Schedules I through V under the state's Comprehensive Drug Control Act. This act modifies the definition to include an altered state of a controlled substance absorbed into the human body.

Current law allows a probation officer who has probable cause to believe a person has violated a condition of probation to issue a warrant for the person's arrest. This act requires a probation officer who has probable cause to believe the person violated a condition of probation to issue a warrant for the person's arrest.

This act creates the Class A misdemeanor offense of ingesting a controlled substance. A person commits the offense by intentionally ingesting, inhaling, or otherwise taking into the body any controlled substance unless the substance was obtained pursuant to a valid prescription.
