HCS/SCS/SB 300 - This act modifies provisions of law regarding the police retirement system of the City of St. Louis, the police and civilian employees' retirement systems of Kansas City, public safety pensions in the City of Springfield, and the public school retirement systems of Kansas City and the City of St. Louis.

POLICE RETIREMENT SYSTEM OF THE CITY OF ST. LOUIS (86.200, 86.213, 86.237, 86.250, 86.251, 86.257, 86.263, 86.270,86.320)

Currently, within the Police Retirement System of the City of St. Louis the medical board, which is responsible for determining disability retirement, is composed of three physicians of different disciplines appointed by the trustees of the police retirement board. This act provides that the medical board shall be a health care organization appointed by the trustees of the police retirement board, and repeals provisions of law which state that opinions and recommendations to the board of trustees regarding disability retirement can be based upon the opinion of a single member or that of an outside specialists, if one is appointed.

Under the act the medical board, rather than a medical director and appointed physicians, is now responsible for the arrangement of all medical examinations and investigations in connection with an application for disability retirement.

The act repeals the existence of the board of police commissioners and grants the various duties of the board of police commissioners to the chief of police or the board of trustees of the police retirement system as specified in the act.

These provisions are identical to provisions contained in HCS/SCS/SB 270 (2015), HCS/SB 283 (2015), and HB 515 (2015).

POLICE AND CIVILIAN EMPLOYEES' RETIREMENT SYSTEMS OF KANSAS CITY (86.1110, 86.1270, 86.1500, 86.1630)

The act provides that a member of the Police Retirement System of Kansas City or the Civilian Employees' Retirement System of the Police Department of Kansas City who after August 28, 2015, returns to employment from a leave of absence for active duty military service and who becomes entitled to reemployment rights shall be entitled to service credit for the time spent in military service only to the extent that such member pays member contributions for the time spent in military service. The total amount of service credit is limited to a maximum of five years, and the retirement board may waive the required contributions for military leave of absence for up to three years of creditable service if the member provides certain documentation.

This act also provides that a nonspouse beneficiary who receives an eligible rollover distribution from either retirement system may have such distribution directly paid to an individual retirement account, an individual retirement annuity, or a Roth individual retirement account.

These provisions are identical to provisions contained in HB 515 (2015), HB 629 (2015), and HB 630 (2015).

PUBLIC SAFETY SALES TAX IN SPRINGFIELD (94.579)

Currently, every five years the City of Springfield must submit to the voters the question of whether to repeal its public safety sales tax. This act modifies the ballot language so that the question will be whether to continue the tax. Failure by the voters to approve continuation will result in a repeal of the tax.

This provision is identical to SB 421 (2015) and SB 607 (2014), and to a provision contained in SS/SCS/HCS/HBs 517 & 754 (2015), HCS/SCS/SB 315 (2015), HCS/SB 364 (2015), and CCS/SCS/HB 1553 (2014).

KANSAS CITY PUBLIC SCHOOL RETIREMENT SYSTEM (169.291, 169.324)

For KC-PSRS, this act reduces the number of trustees elected by the members of the retirement system from four to three beginning at the election in 2016. Beginning at the election in 2016, one member will be a teacher or administrator of a charter school located in the Kansas City School District. This trustee will be elected for a term of four years by the members of the retirement system.

This provision is identical to provisions contained in HB 629 (2015) and HCS/SCS/SB 270 (2015).

Currently, in any school year, if a retiree returns to work in excess of 600 hours or receives more then fifty percent of the annual salary or wages he or she was last paid, payment of the person's retirement allowance will be suspended. This act extends this provision to any person retired and receiving a retirement allowance from the system who is employed by a third party or is performing work as an independent contractor in a district included in the retirement system as a temporary or long-term substitute teacher or in any other position requiring teacher certification if the person was employed by the district. The retirement system may require the district, the third-party employer, the independent contractor, and the retiree to provide documentation showing compliance. If documentation is not provided, the retirement system may deem the retiree to have exceeded the limitations.

This provision is identical to provisions contained in HCS/SCS/SB 270 (2015), HCS/SCS/SB 172 (2015), and HCS/HB 1085 (2015).

PUBLIC SCHOOL RETIREMENT SYSTEM OF THE CITY OF ST. LOUIS (169.450)

This act modifies the composition of the board of trustees of the Public School Retirement System of the City of St. Louis, and modifies the qualifications for the four trustees elected by and from the active members. At least two trustees will be teachers, not more than one trustee will be a nonteacher, and beginning in 2016, one trustee will be a teacher or administrator of a charter school located in the St. Louis City School District.

This provision is identical to a provision contained in HCS/SCS/SB 270 (2015) and HB 629 (2015).

HA 1 - THIS AMENDMENT MODIFIES PROVISIONS THAT PERMIT A RETIRED MEMBER TO RETURN TO WORK WITHOUT HAVING HIS OR HER RETIREMENT ALLOWANCE SUSPENDED BY THE PUBLIC SCHOOL RETIREMENT SYSTEM OF MISSOURI.

HA 2 - THE AMENDMENT PROVIDES THAT IF A RETIRED MEMBER OF THE MISSOURI DEPARTMENT OF TRANSPORTATION AND HIGHWAY PATROL EMPLOYEES' RETIREMENT SYSTEM OR THE MISSOURI STATE EMPLOYEES' RETIREMENT SYSTEM WHO FOLLOWING RETIREMENT IS REHIRED OR APPOINTED AS A STATE EMPLOYEE REIMBURSES THE SYSTEM FOR MONEY RECEIVED AS RETIREMENT BENEFITS THEN SUCH MEMBER SHALL BE TREATED AS AN ACTIVE MEMBER OF THE SYSTEM, AND CREDITABLE SERVICE WILL BE CALCULATED AS IF THE MEMBER HAD NOT RETIRED.

HA 3 - THIS AMENDMENT PROVIDES THAT A STATE EMPLOYEE WHO HAS NOT PREVIOUSLY BEEN A RETIREE OF THE MISSOURI STATE EMPLOYEES' RETIREMENT SYSTEM (MOSERS) AND WHO IS ELIGIBLE TO RECEIVE AN ANNUITY WHICH SHALL BEGIN NO LATER THAN NOVEMBER 1, 2015, SHALL BE ELIGIBLE TO APPLY FOR MEDICAL BENEFITS AS SPECIFIED IN THE AMENDMENT.

HA 4 - THIS AMENDMENT AUTHORIZES THE CITIES OF LIBERTY AND NORTH KANSAS CITY TO IMPOSE, UPON VOTER APPROVAL, A SALES TAX FOR THE PURPOSE OF IMPROVING THE PUBLIC SAFETY OF THE CITY, INCLUDING EXPENDITURES ON EQUIPMENT, SALARIES AND BENEFITS, AND FACILITIES FOR POLICE, FIRE, AND EMERGENCY MEDICAL PROVIDERS.

HA 5 - THIS AMENDMENT ALLOWS A RETIRED MEMBER OF THE PUBLIC SCHOOL RETIREMENT SYSTEM OF MISSOURI WHO HAS ELECTED TO RECEIVE A REDUCED RETIREMENT ALLOWANCE IN ORDER TO NOMINATE A SUCCESSOR BENEFICIARY FOR HIS OR HER RETIREMENT ALLOWANCE TO RECEIVE HIS OR HER FULL RETIREMENT ALLOWANCE UNDER OPTION 1 IN CERTAIN SITUATIONS AS PROVIDED IN THE AMENDMENT. ADDITIONALLY, NOMINATION OF A SUCCESSOR BENEFICIARY IS TO BE FILED WITHIN ONE YEAR, INSTEAD OF THE CURRENT NINETY DAYS, OF THE REMARRIAGE.
