Current Bill Summary

SCS/SBs 787 & 804 - This act creates a Capital Sentencing Procedures and Protocols Commission. The Commission shall have exclusive authority to determine the procedures for the administration of the death penalty, but shall not make policy decisions regarding whether the death penalty should be administered. The Commission shall be composed of eleven members who shall serve without compensation. A majority of the commission constitutes a quorum.

All procedures and protocols established by the Commission shall go through the rulemaking process provided in Chapter 536. During the first year of existence, the Commission must meet at least quarterly and shall draft and promulgate one or more administrative rules for the administration of the death penalty. Such rules shall include the drugs that may be used by the execution team to administer lethal injection. Following the first year of existence, the Commission must meet at least annually.

The death penalty shall not be administered in Missouri until the Commission has promulgated rules or until one year after the effective date of this act.

This act contains an emergency clause.
