HB 1716 - This act modifies the current law regarding the type of proof that must be provided in order to prove lawful presence for driver's license purposes. Under the terms of the act, a driver's license, instruction permit, or nondriver's license may be renewed upon presentment of a U.S. birth certificate and another form of identification approved by the Department of Revenue (U.S. military I.D., U.S. military discharge papers, etc.).

The act also provides that an applicant for a driver's license, instruction permit or nondriver's license shall not have his or her privacy rights violated in the process of providing proof of residence. The act provides that any data derived from an application shall not be sold for commercial purposes to any organization or other state without the applicant's express permission without a court order. The data may be shared with law enforcement agencies, the judiciary, prosecuting attorneys, and other delineated agencies.

The act provides that the state of Missouri shall not participate in any standardized identification system using driver's and nondriver’s records.

The act specifically provides that the Department of Revenue shall not amend its procedures for applying for a driver's license or identification card in order to comply with the REAL ID Act or any rules promulgated thereto.

The act provides that the department shall not expand the motor vehicle records data it shares with other states or the federal government without specific statutory authorization.

The act further prohibits other state agencies from collecting, obtaining or retaining any data in connection with complying with the REAL ID Act.

Under the act, any biometric data previously collected or retained in connection with motor vehicle registrations or the issuance of driver's licenses by any state agency shall be retrieved and deleted from all the databases. This provision only applies to biometric data that has been collected or retained for REAL ID purposes.
