HB 1082 Modifies the laws regarding health care liens

HCS/HB 1082 - This act provides that insurance carriers may pay amounts due secured by liens of health care providers directly if the claimant does not challenge the amount of customary charges, and the amount is the customary charge.

This act provides that privately maintained hospitals, clinics, or other institutions for the care of the sick shall have a lien upon certain claims or rights of action of certain persons, but removes language that specified that the provision would only apply to private hospitals, clinics, or other institutions if they are supposed in whole or in part by charity and located within the state of Missouri.

The act also authorizes hospitals and clinics to place a lien on any wrongful death action, if the person initiating the action has made an oral or written demand or has demanded in the petition the recovery of medical expenses incurred by the decedent.
