Current Bill Summary

SB 1255 - This act enables a public owner to disqualify a contractor or subcontractor from bidding on projects for three years if the contractor or subcontractor has had final payment withheld.

The act would also allow the Division of Design and Construction to declare a contractor in default if the contractor fails or refuses to perform or complete the project. Once declared in default the Division of Design and Construction may directly renegotiate the subcontracts to complete the project. The act also allows the Division of Design and Construction to create a contractor certification program.
