SS/SCS/HB 185 - This act requires a public vote for the adoption of a building code in all first and second class counties which do not have a building code prior to August 28, 2001. Current law only requires a vote by county commission in first and second classification counties. Voters in an incorporated area would not vote on the county proposal, as it would not affect those areas under existing statutes. This act allows first and second class counties to regulate plumbing and drain laying within their building codes.

This act also states that any county adopting a building code after August 28, 2001, shall adopt a 1999 or later edition of a nationally recognized building code.

Under this act, the state of Missouri waives its right to a possible reverter in property located in Scott County. Under this act, the county commission of Clay County may not enter into leases for concession stands or marinas which are longer than 25 years.

This act also allows Clay County to operate a privately operated marina (not to exceed a cumulative total of 24 months) if that operator is in default and no bids are received in the open bid period.

The act exempts any device located in a private building that is not used by the general public from meeting the requirements of Missouri Elevator Safety and Inspection laws and regulations.

This act is similar to HCS/SB 86 (2001).
