Current Bill Summary

SB 673 - This act exempts watercraft liveries from liability for the death or injury of a paddlesport participant resulting from the inherent risk of such an activity unless the livery:

1) Intentionally injures the participant; 2) Commits an act of negligence which proximately causes the death or injury; 3) Negligently provides an unsafe watercraft or equipment; or 4) Fails to provide a lifejacket.

Every livery must post a sign indicating that the livery will not be responsible for the death or injury of a participant resulting from the inherent risks of paddlesport activities. In addition, every contract entered into by a livery and a participant must contain the warning.

This act is similar to SB 154 (1999).
